www.inkplus.ie (the “Website”) is operated by Inkplus Limited (“Inkplus”), a limited liability company registered in Ireland (registered number 396779) with a registered office of 34A Wexford Street, Dublin 2. Any purchases made via the Website are subject to your acceptance of the Terms and Conditions set out herein.

Inkplus reserves the right to change these Terms and Conditions from time to time without notice to you.
Please read the Terms and Conditions carefully in their entirety. None of the provisions of these Terms and Conditions shall be interpreted as depriving you of any rights you may have as a consumer under Irish consumer protection law.

Any conditions which the customer wishes to apply to the supply of goods via the Website must be agreed with Inkplus in writing prior to purchase.

Disclaimer

Subject to your statutory rights and our Guarantee (see below) and to the fullest extent permitted by law:

1. Inkplus will not be liable to you by reason of any warranty, condition or otherwise, or any duty at common law (whether express or implied) or under these Terms and Conditions for any indirect, special or consequential loss or damage (including loss of profits), costs, expenses or other claims for compensation whatsoever (whether or not caused by our negligence) which arise out of or in conjunction with our supply of goods via the Website.

2. Inkplus’ liability to you in respect of any claim shall be limited to the replacement or repair of the products concerned or, at Inkplus’ option, reimbursement of the purchase price or the deemed fair market value, whichever amount is the lesser.

In view of this it is essential to ensure before purchasing any product that it is the correct item for your machine and that you follow instructions enclosed with the product. If in any doubt please contact info@inkplus.ie.

Manufacturer brand names, logos, model numbers and product codes featured on the Website are the property of their respective owners.

Nothing in these Terms and Conditions shall exclude or limit Inkplus’ for death or personal injury resulting from our negligence, or that of any of our employees or agents.

Acceptance of Orders

When you place an order to purchase a product from the Website, you will receive an e-mail confirming receipt of your order and information containing the details of your order. Your order represents an offer to purchase the products, thereby binding you to these Terms and Conditions. Inkplus reserves the right to decline any order without giving a reason.

It is important that you check your order confirmation immediately and promptly notify info@inkplus.ie of any mistake. Otherwise, the order details as set out in the confirmation will apply.

Payment and Card Security

Inkplus accepts payment for all its products by laser card, debit card, credit card and pre-paid credit cards at the time that your order is accepted but before the products are delivered.

In the event that Inkplus agrees to accept payment by cheque, no products will be despatched until the cheque has been cleared by our bank. A €5 collection fee will be charged for any dishonoured cheques.

Once payment has been accepted, an email will be sent to the address you stated in the order confirmation.

Inkplus appreciates your business and it is our intention to make it as secure as possible when ordering products from our website.
All online card transactions are securely processed by Realex Payments, our payment gateway provider. Realex use the latest security technology to ensure that your credit card details are 100% safe. Your credit card details will not be disclosed to Inkplus Ltd or its staff at any time during or after the transaction. We receive a result from Realex indicating whether your transaction has passed or failed. If your transaction is passed the order will be processed. If your card fails you will be sent an error message.

However, if you do not wish to make payments through our online payment system, we are happy to assist you to manually process your transaction. Please telephone us in Dublin on 01 475 1000.

Your business is important to us and we will make it as easy as possible for you to buy from us.

We like talking to people - clients and customers. But, we do most of our business online to save time and money and offer our customers great value. So please help us to go on doing so by ordering online where possible. Your payment will be every bit as safe as a phone order.

Title

Title to the products ordered passes to you when they have been shipped or, if later, when payment is made in full.

Prices Quoted

Unless otherwise stated, prices quoted are only valid during your browser session. Inkplus reserves the rights to change the prices of any or all of its products without prior notification. All prices are quoted in Euro.

VAT

All products offered for sale on this site display prices both exclusive of and inclusive of VAT at the prevailing rate in Ireland.
VAT exempt transactions cannot proceed without our first being in receipt of a copy of a current Revenue Form VAT 13B or Form VAT 56B.

Delivery

Inkplus has its toner and ink shop, office and warehouse premises in Dublin 2. We hold large stocks of the popular products. Small sellers (e.g. IBM, Konica Minolta, Kyocera, Sharp, Toshiba and Xerox) are not kept in stock and there could be a delay of 2 weeks before orders for such product are shipped to you. To minimise this lead time, Inkplus will, in most cases, ship to you directly (drop-ship) from our suppliers in the EU.

Inkplus uses General Logistic Systems (GLS) or An Post for deliveries nationwide Monday-Friday.
Please order online by 4 pm for delivery nationwide the following business day.

In-store collection

There is no extra charge for collecting your orders in-store in Dublin 2. However, to avail of online prices, you must complete and pay for your purchase online and provide proof of identity upon collection.
In the absence of the completed online purchase, our in-store retail prices will apply.

Undelivered Products

If you have not received your order within fourteen (14) days of it having been placed, please contact us. Until such time as that fourteen (14) day period has elapsed Inkplus will not re-send any order. If products have not been received after that period, you/Inkplus may cancel the order in which case a full refund will be paid.

Guaranty

Product guarantees are as follows:

1. Genuine original: If a genuine original product turns out to be faulty Inkplus will replace it or refund the purchase price. As many OEM manufacturers require the end-user to initiate returns directly with them, Inkplus will assist you with any questions you might have.

2. Compatible replacement: If, within twelve months of the date of purchase, a compatible replacement product turns out to be faulty Inkplus will replace it or refund the purchase price.

Fault Claims

In either of the above cases please notify info@inkplus.ie, quoting your details and order number and a brief description of the problem. You will be given a Return Merchandise Authorisation (RMA) number before returning any product. This RMA number will also be used as your reference code until the return has been resolved and finalised.
You will not receive a full refund if you have used over 25% of the product.
If Inkplus or the manufacturer determine that failure of the product or cartridge in question was not caused by a defect in materials or workmanship, or if the reason for return does not involve failure, then Inkplus reserves the right to charge you for the associated costs. Inkplus will advise you prior to making these charges.

Returns

Pursuant to the European Communities (Protection of Consumers in Respect of Contracts Made by Means of Distance Communication) Regulations, 2001 (Statutory Instrument 207 of 2001), a consumer is protected by a number of safeguards and entitlements. A “consumer” for these purposes is someone who is acting for purposes outside of their trade, business or profession.
If you are a consumer you have a cooling off period of 7 working days from the date of receipt of the product(s) during the course of which you may cancel your order. In order to exercise such right, we require that you notify us in writing (see contact details below). If you exercise such right, you must immediately arrange for the return of the product(s) to us. The refund will be made within 30 days of you informing us of your decision to exercise your right to cancel your order. We may deduct our shipping costs from the refund.
This safeguard will only apply if the products in question are to be returned to us in perfectly saleable condition, unopened and unused.
You must request a Return Merchandise Authorisation (RMA) within seven (7) days of receipt of the goods. This RMA number will also be used as your reference code until the return has been resolved and finalised.
You must state whether you desire a credit/debit refund or a replacement product. If the latter option is selected an equivalent replacement will be sent to you.
Please note that this cooling off period does not apply:
1. To products that have been specially ordered for you (see “Returns Exclusion/ Specials” below).
2. If you have opened the product packaging.

Refunds

Refunds will only be credited to the card used to make the original payment.

Returns Exclusion/ Specials

Any special orders placed at the customer’s request for non-stock products cannot be cancelled or refunded.

Queries and Complaints

Notification of queries and/ or complaints must be forwarded to Inkplus in writing within fourteen (14) days of receipt of the products.

Components Resale

A customer shall not resell any products purchased from Inkplus or remove any components from products for the express purpose of resale, without the prior written consent of Inkplus.

Force Majeure

Inkplus will not be liable for delays in performance (including delivery or service) of its obligations where such delay is caused by circumstances beyond its reasonable control. In such circumstances, Inkplus will be entitled to a time extension for performance of its obligation. Examples of circumstances which are outside of Inkplus’ control include an act of God, strikes, problems with suppliers or transport, industrial relations problems, exchange fluctuations, governmental or regulatory reaction and natural and environmental disasters. If the force majeure conditions last for more than 2 months, the agreement may be terminated by either party without compensation.

Entire Agreement

These Terms and Conditions, together with our Terms of Use and Privacy Statement constitute the entire agreement between Inkplus and the customer regarding the sale of products via this Website.

Applicable Law

These Terms and Conditions shall be governed by and be construed in accordance with the laws of Ireland and you hereby submit to the exclusive jurisdiction of the Irish Courts.

Severability

If any provision (or part thereof) of these Terms and Conditions is found to be invalid, illegal or unenforceable, that provision (or part thereof) shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this agreement shall not be affected.

Website Account

Inkplus will not be held liable for any loss or damage caused as a result of third party access to your account. Inkplus retains the right to close your account if it reasonably suspects that you have failed to accord with these Terms of Use.

The content on this Website (ie software, text, graphics, logos, trademarks, images etc) is either the property of Inkplus or one of its licensors. It is protected by copyright and intellectual property law.
You agree not to copy, distribute, reproduce or transmit any of the content on the Website without the prior written consent of Inkplus.

Acceptable Use Policy

The following are conditions upon which you access this Website. You agree to observe the following and undertake:

1. To comply with all relevant laws;

2. Not to use the Website in any way that is unlawful and/or fraudulent, or is of unlawful and/or fraudulent purpose or effect;
